Due to the latest developments, please find hereinafter a special edition of our newsletter, informing you about recent legal changes with impact on the statements regarding the beneficial owner (UBO).
As already announced, companies, foundations and associations have to disclose their UBO due to Romania's new anti-money laundering legislation (Money Laundering Act No. 129/2019). The notification form for this purpose was published in October 2019.
The Romanian Commercial Register recently published a practice-related circular which raises questions regarding the deadline for the first filing in 2020.

Cities of Tomorrow #8 - New Waves of Urban Migration - again with speaker from STALFORT Legal. Tax. Audit.
On September 1st 2020, the eight edition of the conference „Cities of Tomorrow“ will take place.
“Cities of Tomorrow” is the national reference event related to the development of cities and regions. Its scope is to connect the business environment with the local administration, architects, town planners, and representatives of the civil society. New declaration of beneficial owner mandatory for all companies.
The new Romanian anti- money-laundering legislation obliges all companies or subsidiaries which are registered with the Romanian Commercial Register, but also associations and foundations, to disclose their beneficial owner.
As the form for the declaration of the beneficial owner at the Commercial Register has been published, during the next months, action is required for all businesses registered with the Romanian Commercial Register.

Veronica Visinescu analyses the effects of insolvency proceedings in the context of public procurement procedures in the Romanian Magazine on Public Procurement
The latest edition of the Romanian Magazine for Public Procurement (Revista de Achizitii Publice) contains an article by Veronica Vişinescu, responsible for the public procurement practice within STALFORT Legal. Tax. Audit.
The article analyses the effects of the opening of insolvency proceedings against operators during various phases of a public procurement procedure, as well as during the performance of a public procurement agreement.
