Employers must introduce new measures against harassment at work
On October 17th, 2023, the Methodology for Preventing and Combating Gender and Moral Harassment at the Workplace was published. All Romanian employers must implement it by 16. April 2024. The methodology contains a sample guide on preventing and combating harassment at work, as well as a series of obligations for the employer, which must be fulfilled in a short term.
Key obligations for every employer:
- Creating its own guidelines for preventing and combating harassment at work, adapted to the specific situation of the employer;
- Introduction of an internal procedure for promotion, including for decision-making positions, which ensures equal opportunities and equal treatment;
- Annual training of employees on the provisions of the Methodology;
- Inclusion of the provisions of Emergency Ordinance No. 137/2000 on the prevention and sanctioning of all forms of discrimination and Law no. 202/2002 on equal opportunities and equal treatment of women and men in the internal regulations;
- and others.
Sanctions
Employer’s failure to prevent and combat harassment at work may trigger substantial fines ranging between 30,000 RON (EUR 6,000) and 200,000 RON (i.e. approx. EUR 40,000).

Newsflash - New Template For All Employment Contracts In Force
On December 09th 2022, a new template of the employment contract was published in Romania. The legal basis for this new template of the employment contract is represented by Order 2171/ 2022, which, among other things, implements the current changes in Romanian labor law.

NEWSFLASH - Wind of change in Romanian energy law
After several months of public debate and numerous amendments and revisions, Emergency Ordinance no. 143/2021 ("GEO 143") entered into force on the last day of the previous year. It brings significant positive changes to the Romanian energy legislation, including the end of a ten-year-old block on electricity transactions outside centralized markets

NEWSFLASH - REMINDER: Statement Regarding the Ultimate Beneficial Owner (UBO) must be filed in September
Based on the amendments of Romania's legislation against money laundering and terrorism financing (Law No. 129/2019) as of 30 April 2021, among others, the obligation for companies to file with the Commercial Register the annual statements regarding their beneficial owners (beneficiari reali, - “UBO”) was reinstated.
We informed you in May that the term for the filing had been extended until 1 October 2021. Please click here.
Many were hoping for a cancellation of the obligation to file a statement in case no changes related to the UBO occurred.
Currently it seems however that all companies have to comply with the filing term for the annual UBO statement. Considering that such term will soon expire, all concerned parties should take action in order to submit the statement with the Commercial Register in September.
Please also note that in the meantime the form of this statement was amended.

NEWSFLASH - Important changes in employment law –making use of them requires action
In July 2021, the Romanian legislator introduced some changes, regarding (inter alia) the electronic signature, the mandatory content of employment contracts, the recording of working time and the abolition of some obligations.

Laura Neacsu has provided insights on the regulatory framework of the energy infrastructure in Romanian cities and possible cooperation ways between German investors and Romanian public authorities and private bodies at the event “Energy infrastructure in cities“, organized by the Romanian-German Chamber of Commerce and Industry (AHK Romania).
The event took place between April 21-23, 2021 and was an initiative of the Romanian-German economic collaboration project. Its financing came from the Federal Ministry of Economy and Energy in Germany within the “Energy Solutions made in Germany” program.

The introduction of short-time work in Romania was the result of a lengthy process in which Christian Weident was involved from the very beginning on behalf of STALFORT Legal. Tax. Audit.
After the regulations became complicated and unattractive in December 2020 as a result of unfortunate developments in legislation, discussions were resumed at the beginning of the year.
Christian Weident will present their positive result on 15.04.2021 between 15:00 and 16:30 and will discuss them together with other members of the German Romanian Chamber of Commerce and Industry (AHK).

In 2019, AHK Romania initiated the formation of a consortium of German companies to find, together with Romanian companies and interested local authorities, efficient, reliable and environmentally friendly technical solutions to bring electricity to the remote villages from the Apuseni region and not only. From its earliest beginnings, STALFORT.Legal.Tax.Audit has accompanied and assisted the project funded by the Federal Ministry of Economy and Energy (BMWi) and AHK Romania with legal input.
During an online event dedicated to the presentation of the German consortium on March 2, 2021, Laura Neacsu has introduced the attendants to the Romanian regulatory framework and possible structures of microgrids and off grid production as well as consumption places.
